I appear to be in a promotional video

Ladies and gentlemen,

It has just (as in, within the past fifteen minutes) been pointed out to me that the amazing picture of me by the photographer Tarilyn Quinn (http://tarilynquinn.com) has been used in Penguin's promotional trailer for the Katie MacAlister novel Steamed:

I am very flattered and entertained (though really, all the credit goes to Tarilyn for making the photo look so bloody good).

As a closing note, though, if Ms. MacAlister or anyone from Penguin happens to be on or watching this community, I understand that Tarilyn was not credited in the video or in its description on the Youtube page. If it would be possible for someone to correct this, I think it would only be right. It would make her very happy.

EDIT: P.S. The photographer knows about this. To the general public, thank you all for your support. However, please do not contact the publisher for us. Tarilyn has contacted them herself and will take care of the discussion with them on her end.

EDIT: Rather than resolving the issue with the artists so that they can get some benefit from this, the video appears to have been pulled. However, so that you all know what is being talked about, I've changed the link to one which someone else uploaded and which is still online. Whoever uploaded it is providing a clear record of what was stolen.

Considering her skill, it's only right she gets recognition.

Also, her choice of subjects isn't at all bad.

Tarilyn should call Penguin's main switchboard at 212-366-2000, explain the situation to the operator, and asked to be transferred to someone who can help her.

She should also send them a cease and desist IN WRITING, as well as complain to YouTube to have the trailer pulled under the DMCA. (She needs to go here, flag the video, and select "Infringes my rights" and "Infringes my copyright", and also follow the procedures here.)

Yes, I know that all sounds very harsh, but if she wants to ensure that she receives credit for her work - if not outright remuneration - she's going to need to be a hardass about it now.

Yes. Large publishers like Penguin pay for promotional material.

G.D.'s image is being used for promotional purposes without his permission (something Penguin's legal department will go into fits about).

Tarilyn's copyright has been infringed, and she holds the power to have the video removed.

I do know a lawyer that specializes in entertainment law... I suspect he could help if the involved parties are interested. Credit for the image is the very least of what is owed here...

I wonder if that illustration in the video was stolen as well?

This leaves a really bad taste in my mouth. Especially because the book is obviously pandering to our community while simultaneously stealing from it.

I think it goes beyond deserving credit. I think if your work is going to be pirated for advertising, they should certainly compensate you both! :(

Aside from other many issues, what I find funny is that they go to all the trouble of finding (stealing) the image of the man, but they use an illustration of the woman. huh? Why not just go ahead and pirate the image of a woman too? It looks ridiculous having a cartoon woman and a real man.

But, I agree with the others. Regardless of whether you should've been offered monetary compensation; that's for you to work out with the publishers, at the very least, they have a legal obligation to obtain the permission of all involved I would think.

Actually the drawing of the woman is likely the one thing they did not pirate, it's on the cover of the book.

As for him recieving monetary compensation it's between him the the photographer not the publisher, assuming she still retains the copyright to the photo. Now the photographers beef Should be with the publisher.

You know what my problem is with this type of book?

All those hours of work that go into making a bodice; the corsetry, the measuring, the sewing, the decorating, scouring thrift stores, ebay, and old machine shops for just the right accessories...it just strikes me as wasteful to go around ripping a perfectly good bodice. More than wasteful! I say to you, it is contemptible, nay, criminal.

I'm the mean girl here. I contacted Penguin legal and provided links to all the stolen material. Nothing nasty, just a, "Hey, you might want to look into this," sort of thing. Especially since it's looking like you and Ms. Quinn aren't the only people they stole from. The ball's in their court now.

Heh. My roommate runs steampunkwallpaper.com -- the background that appears around 0:59 is from her site and she has not been credited either. While delighted and amused, she'll be contacting Penguin as well regarding the violation of Creative Commons.
